Important: These Terms do not create a client, advisory, fiduciary, attorney-client, CPA-client, trustee, or tax-preparer relationship. Written agreements and required onboarding documents govern any formal engagement.

Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and Echelon Heritage Group, LLC, together with its affiliates and subsidiaries ("Echelon Heritage," "EHG," "we," "us," or "our"), governing your access to and use of the website located at www.echelonheritagegroup.com and any associated sub-domains, pages, content, tools, forms, and online services (collectively, the "Site").

By accessing, browsing, registering on, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use the Site.

Changes to the Terms

We reserve the right, in our sole discretion, to modify, amend, supplement, or replace any portion of these Terms at any time. Revisions become effective upon posting to the Site, and the "Last Updated" date above will reflect the most recent change. Your continued access to or use of the Site following any such change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

About Echelon Heritage Group

Echelon Heritage Group, LLC is an Indiana limited liability company headquartered in Indianapolis, Indiana. The Site provides general information about Echelon Heritage and the services offered through its affiliated business divisions, which may include investment advisory, tax planning, estate and trust services, and retirement and insurance planning. Each division operates under its own applicable licenses, registrations, and regulatory framework, and services are subject to separate written engagement agreements.

Nothing on the Site constitutes the formation of an advisory, fiduciary, attorney-client, accountant-client, or other professional services relationship between you and Echelon Heritage. A formal relationship is established only upon execution of a written engagement agreement with the appropriate Echelon Heritage entity.

Eligibility

The Site is intended for users who are at least eighteen (18) years of age and who have the legal capacity to enter into binding contracts. The Site is directed to residents of the United States, and we make no representation that content on the Site is appropriate or available for use in any other jurisdiction. By using the Site, you represent and warrant that you meet these eligibility requirements.

Informational Purpose Only

All content on the Site — including text, articles, white papers, charts, graphics, videos, calculators, illustrations, and other materials (collectively, "Content") — is provided for general informational and educational purposes only. The Content does not constitute, and should not be relied upon as, investment, tax, legal, accounting, estate-planning, insurance, or other professional advice tailored to your individual circumstances.

You should not act, or refrain from acting, on the basis of any Content without first obtaining personalized advice from a qualified professional who has reviewed your specific situation. Your use of, or reliance upon, any Content is at your sole risk.

The "Echelon Heritage Group" name, related logos, taglines, and all associated trademarks and service marks are the property of Echelon Heritage Group, LLC. You may not use any such marks without our prior written consent.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use. You may download or print individual pages solely for personal, non-commercial purposes, provided that all copyright and other proprietary notices remain intact. Any other use — including reproduction, modification, distribution, transmission, republication, public display, framing, scraping, data mining, training of artificial-intelligence or machine-learning systems, or commercial exploitation of the Site or its Content — is strictly prohibited without our prior written consent.

User Submissions and Communications

Any inquiry, comment, suggestion, idea, question, feedback, résumé, document, or other material that you transmit to us through the Site, email, contact forms, or other channels (collectively, "Submissions") will be treated as non-confidential and non-proprietary, except to the extent that the Submission contains personal information governed by our Privacy Policy, or it is exchanged within the context of an existing engagement or under a separate confidentiality agreement.

By transmitting a Submission, you grant Echelon Heritage a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Submission for any lawful business purpose, subject to applicable law and our Privacy Policy. You represent and warrant that you own or otherwise control all rights to your Submission and that the Submission does not violate the rights of any third party or any applicable law.

Do not transmit confidential, sensitive, or personally identifying information (including account numbers, Social Security numbers, dates of birth, or detailed financial data) through unsecured channels such as standard email or web contact forms. Such transmissions are not secure and may be intercepted.

Permitted and Prohibited Use

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You agree not to:

  • Use the Site in any manner that violates applicable federal, state, local, or international law or regulation;
  • Attempt to gain unauthorized access to any portion of the Site, its servers, related systems, or networks, or to any account, computer system, or network connected to the Site;

  • Collect or store personal information about other users;
  • Use the Site to transmit unsolicited advertising, "spam," chain letters, or any form of mass communication;
  • Engage in any fraudulent, deceptive, or manipulative activity; or
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software made available through the Site.

We reserve the right to investigate suspected violations of these Terms, to suspend or terminate access for any user, and to cooperate with law enforcement authorities in connection with any investigation.

Privacy

Our collection, use, storage, and disclosure of information from users of the Site is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.

Electronic Communications

When you communicate with us through the Site or provide your contact information, you consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing, except where applicable law specifically requires a different form of communication.

You acknowledge that electronic communications — including email, web forms, text messages, and chat — are not necessarily secure and may be subject to interception, loss, or alteration.

Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, FEATURES, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ECHELON HERITAGE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENCY, AND UNINTERRUPTED ACCESS.

We do not warrant that: (a) the Site will meet your requirements; (b) access to the Site will be uninterrupted, timely, secure, or error-free; (c) any defects will be corrected; or (d) the Site or the servers that make it available are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so portions of this disclaimer may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ECHELON HERITAGE GROUP, LLC, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, REPRESENTATIVES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, THE TOTAL AGGREGATE LIABILITY OF ECHELON HERITAGE AND ITS AFFILIATES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).

Nothing in these Terms is intended to limit any liability that cannot be lawfully limited or excluded under applicable law, including rights and remedies available under federal and state securities laws, which may not be waived.

Indemnification

You agree to indemnify, defend, and hold harmless Echelon Heritage Group, LLC, its affiliates, and their respective officers, directors, members, managers, employees, representatives, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site; (b) your breach of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any Submission you transmit through the Site.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Termination

We may, in our sole discretion and without notice or liability, suspend or terminate your access to all or any portion of the Site at any time, with or without cause. Sections 5 through 21 of these Terms, together with any other provision that by its nature should survive termination, shall survive termination of these Terms and your access to the Site.

Governing Law and Dispute Resolution

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or the Site, shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

You and Echelon Heritage agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site that is not subject to a separate arbitration provision in another agreement between us shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and you irrevocably submit to the personal jurisdiction and venue of such courts.

Nothing in this Section limits any non-waivable right of action under the federal or state securities laws.

Severability and Waiver

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, or, if such modification is not possible, severed from these Terms, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Entire Agreement

These Terms, together with our Privacy Policy and any other notices or agreements posted on the Site or executed between you and Echelon Heritage, constitute the entire agreement between you and Echelon Heritage with respect to the Site and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, regarding the same subject matter. In the event of a conflict between these Terms and a fully executed engagement agreement with an Echelon Heritage entity, the engagement agreement shall control with respect to the services covered by that agreement.
